Terms & Conditions

These terms govern your use of Sink Bathhouse and related services provided by Sink Limited ("Sink", "we", "us", "our"). By booking or attending, you agree to these terms, our conditions of entry, and our health and safety waiver. This document affects your legal rights — please read it carefully. We may update these terms; updates take effect once published on our website.

1. Acknowledgement of Risk

Participation at Sink involves inherent risks, including but not limited to:
- Exposure to high heat and extreme cold
- Dizziness, fainting, dehydration, nausea, or loss of consciousness
- Heat exhaustion from sauna use
- Hypothermia or cardiovascular strain from cold plunge exposure
- Respiratory distress from inhaling cold air or water
- Slipping or falling on wet surfaces
- Muscle strain or physical injury
- Burns or adverse reactions to heat or cold
- Aggravation of existing medical conditions
- Injury caused by other guests
- Equipment malfunction or facility failure
- Allergic reactions to oils, fragrances, cleaning products, or amenities
- Illness, infection, or communicable disease exposure

These risks may result in serious injury, illness, permanent disability, or death. By attending, you voluntarily assume all risks associated with entering and using Sink's facilities and activities.

2. Health Declaration

By attending, you confirm that:
- You are physically and medically fit to participate.
- You do not have a medical condition that may make participation unsafe.
- You will consult a medical professional beforehand if unsure of your suitability.

- You will stop participating immediately if you feel unwell.
Sink staff are not medically trained and cannot advise on your fitness to
participate — it is your responsibility to seek medical advice beforehand if you are unsure.

Sauna, steam room, hot pool, and cold plunge use may not be suitable for people with:
- Heart, blood pressure, or respiratory conditions
- Neurological disorders or epilepsy
- Diabetes
- Recent surgery, or injury
- Heat sensitivity, or any condition affected by heat or cold exposure
- Pregnancy — sauna and plunge pool use involves elevated body temperature and circulatory changes. As with the conditions above, it's your responsibility to assess your own suitability and consult your healthcare provider beforehand.

You must inform staff of any relevant medical condition before entering. Sink may restrict attendance or require medical clearance where necessary. Recommended usage times shown by staff or signage are guidelines only, and you are responsible for monitoring your own condition — leave immediately if you feel dizzy, faint, nauseous, overheated, numb, or distressed.

3. Liability Release

To the fullest extent permitted by law, you release Sink Limited, its directors, employees, contractors, instructors, and affiliates from liability for claims, damages, losses, costs, or expenses arising from personal injury, illness, death, property loss or damage, or participation in activities or use of facilities — except where liability cannot legally be excluded under the Consumer Guarantees Act 1993 or Fair Trading Act 1986.

4. Medical Emergencies

In the event of illness, injury, or emergency, you authorise Sink to seek medical assistance on your behalf if necessary, and you may be responsible for any associated medical costs.

5. Conditions of Entry

All guests must:
- Follow all staff directions and safety instructions
- Shower before entering sauna, pools or bathing areas
- Wear appropriate swimwear
- Remove shoes before entering the change room and bathing areas
- Respect the environment
- Use facilities responsibly and hygienically

No alcohol is permitted on the premises. Entry is prohibited while intoxicated or under the influence of drugs. Sink may refuse entry or remove any guest, without refund, for: unsafe behaviour, aggression or harassment, intoxication, disruptive conduct, failure to comply with these terms, or behaviour impacting the safety or comfort of others.

6. Age Restrictions

Guests must be 18 or older to attend Sink. Guests aged 16–17 may attend with a guardian present at all times. Guardians must pay for entry and are responsible for the minor in their care throughout the visit.

7. Accessibility

Sink does not currently have assisted-access equipment or a pool hoist. Guests who require physical assistance to enter or exit pools or sauna areas must be accompanied by their own support person. Please get in touch before your visit at hi@sinkbathhouse.co.nz so we can discuss how we can accommodate your needs within the limits of our current space.

8. Hygiene & Health Protection

Guests must not enter if they are unwell, have a contagious illness, or have open wounds or infectious skin conditions. Sink reserves the right to refuse entry on health and hygiene grounds.

Clean swimwear must be worn at all times — please avoid anything with zips, hardware, or non-swim fabric.

9. Personal Property

Lockers are provided as a convenience only. Personal belongings are brought at your own risk — Sink is not responsible for loss, theft, or damage to personal items.

10. Photography & Privacy

No phones or photography of any kind are permitted inside the bathhouse. Phones must stay in your locker in the changing room. Commercial photography or filming by guests requires written approval.

11. Bookings, Cancellations & No-Shows

Cancellations must be made through the app or booking system — we cannot accept cancellations by email, phone, or social media. Late arrivals may result in reduced session time.

- More than 6 hours before your session: your session is returned to your account.
- Less than 6 hours before your session: the session is forfeited.
- No-show: the session is forfeited
- Refunds are not offered for missed or cancelled sessions, except where Sink cancels due to unforeseen circumstances. Sink may cancel a session due to low attendance or unforeseen circumstances; you'll be notified at least 2 hours before the session start and your session will be returned.

Group Bookings & Private Events
Group bookings may require a deposit or full prepayment at the time of booking. Please email hi@sinkbathhouse.co.nz to book. Group booking cancellations made within 7 days of the booking date are non-refundable. Changes to guest numbers within 48 hours of the booking may not be accommodated. Private events and exclusive hire bookings are non refundable unless otherwise agreed in writing.

Exceptional Circumstances
We understand unexpected situations can arise. Requests relating to emergencies or exceptional circumstances outside the standard cancellation window may be reviewed at management's discretion.

12. Payments, Pricing & Packs

Payment is required prior to booking. All purchases are final unless otherwise required under the Consumer Guarantees Act 1993. Sessions, memberships, packs, and passes are non-transferable, cannot be shared between individuals, and cannot be exchanged for cash. Booking others under your name may result in termination of your membership.

Sink may update pricing, with a minimum of 4 weeks' written notice to members. Sessions are non-refundable and non-transferable , except by request in special circumstances. Extensions are available for injury or illness with a medicalcertificate, requested before the expiry date. Guest passes are available to first- time visitors only.

Towel Hire
Hired towels remain the property of Sink. A towel not returned by the end of your session will be charged at the cost of replacement, currently $32. Towels returned damaged beyond normal wear will be charged at the same rate.

13. Memberships

Memberships operate on a recurring (weekly or monthly) autopay to the card on file, and continues until Sink receives written notice of termination. New memberships have an 8-week minimum commitment; after that, cancellation requires 1 weeks' written notice.

It's your responsibility to ensure sufficient funds are available for autopayments. If a payment is declined, Stripe may charge an additional fee. Sink may process payment at any time to settle an outstanding balance. If a renewal payment fails, it will auto-retry for 3 days; after 3 days, future bookings are cancelled and the membership terminated.

Suspensions
Memberships can be suspended with a minimum of 5 days' written notice, for between 5 days and 8 weeks. Email hi@sinkbathhouse.co.nz to arrange.

Termination
1 week's written notice is required to terminate a membership. Immediate termination is available for long-term injury or illness with a medical certificate. Sink may terminate a membership without notice for inappropriate, offensive, or illegal behaviour, or any other reasonable cause.

14. Gift Vouchers

Gift vouchers are non-refundable, non-transferable, and valid for 12 months from purchase unless otherwise stated.

Lost or expired gift vouchers may not be replaced.

15. Getting Here

There is no onsite parking at Sink. Street parking is available on Park Road and surrounding streets, and a bike rack is located across the street. The nearest bus stop is Park Road / Brussels Street.

16. Website Use

You agree not to copy, modify, or distribute website materials; reverse-engineer or attempt to extract code; use the website to send spam or unlawful material; infringe any intellectual property or privacy rights; or use the website in violation of applicable law. Website content is owned or licensed by Sink Limited and may be downloaded for personal, non-commercial use only.

17. Governing Law

These terms are governed by the laws of New Zealand, and any disputes are subject to the jurisdiction of the New Zealand courts. Nothing in these terms excludes any right that cannot legally be excluded, including under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

18. Acknowledgement & Agreement

By booking or attending, you confirm that:
- You have read and understood these terms, conditions of entry, and health and safety waiver.
- You understand the risks involved and voluntarily agree to participate.
- You agree to comply with all Sink rules and staff directions.
- You are at least 18 years old, or attending with a guardian present as set out in Age Restrictions above.
